Explosive audio recording rocks Sibiya’s bail hearing

An explosive 25-minute audio recording caused the Randburg Magistrates’ Court to go silent on Tuesday during the bail application of former Deputy National Police Commissioner Shadrack Sibiya.

In the recording, businessman Serge Cabonge can be heard making several allegations about Sibiya, controversial business Vusimuzi ‘Cat’ Matlala, and others who have appeared before the Mandlanga Commission of Inquiry. Cabonge indicates that Sibiya conducted numerous dealings through Sgt. Fannie Nkosi.

The recording was captured by a man known as Mr M, who is the father of the 16-year-old complainant in the case, during a telephonic call with Cabonge.

Mr M has also raised concerns about his safety and alleges that Sibiya threatened him and his family.

Sibiya faces numerous charges including raping an 18-year-old, human trafficking and the sexual grooming of a minor, allegations he has denied.

The state has opposed Sibiya’s release on bail and has relied on recordings and other evidence to argue that Sibiya could interfere with witnesses if he is released.

Meanwhile, the magistrate has requested victim impact statements of the two young complainants and that the victims provide their perspectives regarding safety concerns, intimidation, and interference, should Sibiya be released on bail.

Sibiya’s defense has challenged the state’s version of events and disputed claims

Proceedings will continue Wednesday, 14 October 2026.

Sibiya has since resigned from his position in the South African Police Service (SAPS) on Monday 12 October ahead of the disciplinary hearing disciplinary against him.
