Brown Mogotsi denied bail in alleged staged shooting case

Businessman and alleged political fixer Brown Oupa Mogotsi will remain behind bars after the Johannesburg Magistrates’ Court denied him bail in a case stemming from an alleged staged shooting incident in Vosloorus.

The National Prosecuting Authority (NPA) has welcomed the court’s decision, describing it as a reflection of the seriousness of the allegations and the importance of safeguarding the interests of justice.

Mogotsi faces multiple charges, including unlawful possession of a firearm, unlawful possession of ammunition, discharging a firearm in a built-up area, defeating or obstructing the course of justice and perjury.

The charges relate to an incident in which the State alleges Mogotsi orchestrated a shooting involving his own vehicle before providing false information to police and later making false statements under oath regarding the circumstances of the incident.

During the bail proceedings, the State opposed Mogotsi’s release on several grounds. Prosecutors argued that he had failed to cooperate with investigators, evaded law enforcement authorities and provided contradictory and unverifiable residential addresses.

The State also alleged that Mogotsi attempted to improperly influence the investigating officer involved in the case.

In its ruling, the court found that Mogotsi had failed to satisfy the legal requirements necessary for his release on bail and that the interests of justice did not permit his release.

The magistrate expressed concern over the residential addresses provided by the accused, finding that he had failed to establish a verifiable fixed address. The court held that this raised concerns about whether he would stand trial if released.

As a result, Mogotsi will remain in custody pending his next court appearance on 12 June 2026.

The matter has been postponed for the disclosure of the contents of the police docket and the setting of a trial date.

The NPA said the decision underscored the court’s role in ensuring that justice is not undermined.

“The denial of bail underscores the seriousness of the allegations and the court’s role in ensuring that justice is not undermined,” Magaboke Mohlatlole NPA Communications Officer for the Gauteng Division in Johannesburg said.

He added that the NPA remains committed to presenting its case before court and ensuring that the matter is finalised in accordance with the law.
