North West businessman and alleged political fixer Brown Mogotsi will remain in custody after the Johannesburg Magistrate’s Court postponed his case to Monday, 25 May 2026, for a formal bail application.
Mogotsi appeared briefly in court on Monday after spending the weekend behind bars following his arrest on Friday afternoon.
His arrest came shortly after his appearance before the Madlanga Commission of Inquiry.
It stems from allegations that he staged an attempted hit on his life in Vosloorus, Ekurhuleni, last year.
During proceedings, Mogotsi’s legal representative, Makau William Sekgatja of Radasi Sekgatja Inc, requested a shorter postponement period to allow police to verify the accused’s residential address in Mmabatho, in the North West.
Sekgatja argued that a seven-day postponement for address verification was excessive and unreasonable, particularly as the state had not yet indicated its position regarding bail.
“We request a date less than seven days for address verification,” Sekgatja told the court.
He further argued that the matter could be postponed to Thursday instead, adding that it was Mogotsi’s first appearance before court and that the accused had complied with his duty to disclose pending matters.
The state, however, maintained that additional time was needed to verify the address because it falls outside Gauteng.
According to the prosecution, had the address details been furnished earlier, the postponement may have been avoided.
The state informed the court, that it was not yet in a position to indicate its final stance on bail until the verification process had been completed.
Prosecutors further stated that the matter involves a Schedule 5 offence.
The state also argued that postponing the matter only until Thursday would not provide sufficient time for police to complete the address verification process.
In response, the defence conceded that the full address had not initially been provided timeously, but argued that investigators should have anticipated the logistical arrangements needed for verification.
Sekgatja told the court that the investigating officer had previously visited Mogotsi’s business premises in March and was familiar with the area where the accused resides.
After hearing submissions from both parties, the magistrate ruled in favour of the state’s request for a postponement.
“I have considered the request by the state and submissions by the defence. The state is entitled to a postponement,” the magistrate said before ordering that the matter be adjourned to 25 May 2026 for a formal bail application.
Mogotsi remains in custody pending his next court appearance.
