The bail hearing of suspended Deputy National Police Commissioner Shadrack Sibiya has been postponed to next Wednesday, where the defence will continue to cross examine the investigating officer.
The hearing was heard over three days week in the Randburg Magistrate court.
Sibiya faces charges including rape, human trafficking, sexual grooming of a minor and a firearm related charge.
He was arrested on 21 September at The Grand in Sandton and remains in custody. The State is opposing his release on bail.
During Friday’s hearing Sibiya’s lawyer advocate Amanda Nel questioned investigating officer Detective Sergeant Nokukhanya Ndlovu about the circumstances surrounding his arrest.
The defence questioned whether Sibiya was arrested inside the strip club at The Grand or at the restaurant area.
Ndlovu told the court that Sibiya was arrested inside the strip club.
This has been disputed by the defence, with Nel putting it to the officer that Sibiya was having dinner with three other men in the restaurant when police arrived to arrest him.
A version Ndlovu disagreed with.
The court also heard more about the three young women who are allegedly taken to The Grand and later to the Garden Court hotel.
The State alleges that Sibiya took the women to The Grand where they drank alcohol before going back to the hotel.
One of the women, who was 18 at the time, allegedly became intoxicated and lost consciousness. This is when Sibiya allegedly raped her.
Sibiya has denied the rape allegation and maintains that the sexual encounter was consensual.
The defence further questioned the role of a man known as Mr M who allegedly helped transport the women to the hotel.
Nel questioned the investigating offier why Mr M was not facing a human trafficking charge while Sibiya faces one.
Throughout the bail hearing, the court heard evidence regarding a 16 year old, and according to Ndlovu, Sibiya allegedly communicated with the teenager using WhatsApp, requesting explicit pictures and videos from her.
The State has accused Sibiya of sexually grooming the girl.
The defence disputes parts of the state’s version and questioned how Sibiya came into possession of some of the material.The state also raised concerns about possible witness interference if Sibiya is released on bail, saying Sibiya knows some of the people involved and could therefore contact them.
