Brown Mogotsi’s second bail bid dismissed

Johannesburg – Businessman and alleged political fixer Brown Mogotsi’s second attempt to secure bail has been dismissed after the court found that no new facts had been presented to warrant a different ruling.

Delivering judgment on Monday morning, the magistrate said the court had considered both the evidence presented during the initial bail application and the alleged new facts submitted by the defence. However, the court found that the information did not constitute new evidence.

“There are no new facts at this stage. My decision still stands – bail is denied,” the magistrate ruled.

The court also raised concerns about the residential address submitted as part of Mogotsi’s bail application.

According to the magistrate, the address had been provided by the applicant and confirmed by his wife. However, investigations established that the property does not belong to Mogotsi, a factor that weighed against his application.

During proceedings, the State informed the court that its investigation into the matter has been concluded and that it possesses video evidence related to the case.

Mogotsi remains in custody and the matter has been postponed to 8 July for the arrangement of a trial date.

Mogotsi faces multiple charges, including unlawful possession of a firearm, unlawful possession of ammunition, discharging a firearm in a built-up area, defeating or obstructing the course of justice and perjury.

The charges relate to an incident in which the State alleges Mogotsi orchestrated a shooting involving his own vehicle before providing false information to police and later making false statements under oath regarding the circumstances of the incident.
